Terms and Conditions of Sale

This website, www.fucoidan1.shop ("Site"), is administered by J-PORT Company (“J-PORT”) of 166 Georgetown Drive, Mountain View, CA 94043 as the seller of FUCO’MIN in the USA and the sales office (“Sales Office”) is at 4660 La Jolla Village Drive Suites 100 & 200, Office #259, San Diego, CA 92122. The Site is not directed to the users in the European Union for the purpose of the GDPR.

FUCO’MIN sold on the Site is principally for domestic and private use, but not commercial, business or resale purposes. If you are not a consumer, please make contact with the Sales Office by sending email to us-sales@fucoidan1.jp.

The following are the terms and conditions (“Terms”), on which we sell FUCO’MIN on the Site to consumers. Please note that the Terms only apply to the sales of FUCO’MIN on the Site. Any purchase of FUCO’MIN from any other sources (including, without limitations, third party stores and websites selling FUCO’MIN) (“Other Sources”), will be governed by the terms and conditions applicable at the relevant Other Sources. Please note that promotions and offers available for purchases on the Site may not be available for purchases through the Other Sources and vice versa.

Please be aware that by purchasing on the Site, you will be required to accept the Terms. Please read the Terms carefully and make sure that you understand them before ordering FUCO’MIN on the Site.

We reserve the right to amend and will amend the Terms from time to time. Every time you wish to purchase FUCO’MIN on the Site, please check the Terms to ensure that you fully understand the Terms applicable at that time.

Sale Contract

Before placing your order, please take the time to check the details of your order at each page of the order process, as you will not be able to make any changes to your order after this point.

After you place your order, you will receive an order confirmation email from us.

Once our acceptance Email is sent out to you, unless we receive a written cancellation notice from you within 24 hours, no cancellation to your order will be accepted.

Payment

You pay for the purchase of FUCO’MIN, applicable taxes and delivery charges on accepted payment methods. Please note that you are paying on your credit card processor’s site but not on the Site. J-PORT cannot and will not collect or hold, in any manner, your credit card details.

All credit cardholders are subject to validation checks and authorization by their card issuer. If your credit card payment cannot be processed, you should contact your card issuer to try to resolve the problem. Any payment for your order must be cleared by us before the FUCO’MIN ordered is dispatched. If your payment cannot be processed, your order will be rejected.

Delivery

Once the payment for the purchase of FUCO’MIN on the Site is authorized, we will send you an Email that confirms that the FUCO’MIN ordered has been dispatched.

Delivery charges will be applied in addition to the prices for the FUCO’MIN you are purchasing.

Please provide us with complete and accurate delivery address and recipient’s name. We will not be liable for delivery of your order to a wrong address or a wrong person as a result of you supplying us with incomplete or inaccurate information.

We will make every effort to deliver your order within estimated timescales. However, you agree that delays are occasionally inevitable due to unforeseeable reasons or events beyond our control.

 

Risk and title in the FUCO’MIN passe to you on the date and time of delivery of it to you by the delivery agent.

Returns

If you believe the FUCO’MIN delivered to you is faulty, that is, it does not meet our specifications of FUCO’MIN, you may return it to us with a proof of the purchase e.g., a packing slip, within 7 days from the date of delivery to you. Once we receive the returned FUCO’MIN, we will replace it at our costs.

If you change your mind and wish to return the FUCO’MIN that has been delivered to you, you may return it at your costs within 3 days from the date of delivery to you, provided that the package of the FUCO’MIN delivered is unopened. We will refund the purchase price once the unopened FUCO’MIN is received by us. 

 

Limit of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL J-PORT BE LIABLE FOR ANY INDIRECT, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH FUCO’MIN OR ITS SALES ON THE SITE, WETHER OR NOT J-PORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES FROM ANY COMMUNICATION, INTERACTION OR MEETINGS WITH OTHER PURCHASERS OF FUCO’MIN, BASED ON ANY THEORY OF LIABILITY (INCLUDING CONTRACT, TORT INCLUDING NEGLIGENCE, OR HOWSOEVER OTHERWISE) ARISING OUT OF, IN CONNECTION WITH, OR RESULTING FROM THE SALE OF FUCO’MIN ON THE SITE. J-PORT’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SALE OF FUCO’MIN SHALL IN NO EVENT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO J-PORT OR $500, WHICHEVER THE LOWER.

 

General Terms

  1. When you use the Site we will use your personal information in accordance with the Privacy Policy [https://fucoidan1.myshopify.com/policies/privacy-policy] . The Privacy Policy sets out how we will use information about you and how your information may be shared with third parties. Please read the Privacy Policy carefully and obtain full understanding of it. By placing an order on the Site, you will confirm your acceptance of the terms of the Privacy Policy.

 

  1. The Site uses cookies in accordance with our Cookies Policy described in the Privacy Policy. The Cookies Policy tells you how we collect and use information collected by cookies on the Site. Please read the Cookies Policy carefully to obtain full understanding of it. By using the Site, you will confirm acceptance of the terms of the Cookies Policy.

The Terms and any document expressly referred to in them, the Privacy Policy, the Cookies Policy constitute the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to their subject matter.

 

  1. When you purchase FUCO’MIN on the Site, the sale contract formed is between you and us. No other person shall have any rights to enforce any of its terms.

 

  1. Each of the clauses of the Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.

 

  1. If we fail to insist that you perform any of your obligations under the Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

 

  1. The Terms are governed by the laws of the State of California without regard to principles of conflict of laws.

 

  1. Any dispute or claim out of or in relation to the sale of FUCO’MIN on the Site will be finally resolved by arbitration, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be held in the State of California under the Federal Arbitration Act and shall be conducted by an arbitrator according to the arbitration rules of the American Arbitration Association (AAA) including the AAA's Supplementary Procedures for Consumer-Related Disputes.
